This Privacy Policy describes how WebCareHealth Services, Inc. and its controlled affiliates (“WebCareHealth”) collect, use, and disclose information that we collect from you, as well as how we protect and secure your data. This Privacy Policy generally applies to Personal Information that WebCareHealth collects, uses, and discloses. However, this Privacy Policy is subordinate to any specific terms and conditions set forth in any business associate or patient agreements, end user license agreements, or other agreements with WebCareHealth related to a particular product, service, or data that is collected. It is also important to note that this Privacy Policy applies to information collected, used, and possessed by WebCareHealth and its controlled affiliates, but not to its network of independent dealers and distributors, which may have their own privacy policies that apply to information that they collect from you.

What Types of Information and Data Does WebCareHealth Collect, and When Does It Collect This Data?

We collect various types of personal information about you when you provide it to us and when you use our services.

These Purposes may be necessary for WebCareHealth to perform a contract to which you are a party, comply with a legal obligation to which WebCareHealth is subject, protect WebCareHealth’s vital interests or the interests of another natural person, or otherwise pursue WebCareHealth’s legitimate business purposes and objectives. We may obtain your consent to process your Personal Information, as necessary.


WebCareHealth collects Non-Personal Information in the same ways it collects Personal Information, described elsewhere in this Privacy Policy.


In addition, WebCareHealth reserves the right to use anonymized and aggregated Personal Information to improve its products and services, to create and publish reports, to conduct statistical analysis about our customers and products, and for other activities that do not result in the disclosure of your identifiable information.


To the extent that your information constitute constitutes Protected Health Information, as defined by the Health Insurance Portability and Accountability Act (“HIPAA”), such information will be maintained and used consistently with the requirements of applicable law.


When Will We Disclose Your Information and Who May Receive it?

WebCareHealth is committed to being transparent regarding the manner in which we use and disclose your information. We may disclose and share your information as follows:

  • -- We may share WebCareHealth with authorized physicians, clinic, and other medical personnel, as needed to accomplish, and consistently with, the Purposes set forth above, or as you authorize or request.
  • -- We may disclose Personal Information where needed to affect the sale or transfer of business assets, to enforce our rights, protect our property, or protect the rights, property, or safety of others, or as needed to support external auditing, compliance, and corporate governance functions.
  • -- We will also disclose Personal Information when required to do so by law, such as in response to a subpoena, including to law enforcement agencies and courts in the countries where we operate.

As noted above, WebCareHealth reserves the right to use and disclose anonymized and aggregated Personal Information to improve its products and services, to create and publish reports, to conduct statistical analysis about our customers and equipment, and for other activities that do not result in the disclosure of your identifiable information.


How Long Will We Keep Your Information?

WebCareHealth keeps different kinds of personal data for different lengths of time, depending on the Purposes for which they are processed and the unique circumstances of your situation. We will hold your Personal Information as long as necessary for the relevant Purpose. Website Data Collection, Cookies, and Similar Technology

The Website may use third party analytics service providers such as Microsoft Azure Application Insights (“App Insights”) to evaluate and provide us with information about the use of the website and viewing of content on the website.

Third party analytics service providers may themselves set and access their own cookies and track certain behavioral usage information regarding users of your computer using their own tracking technologies. Third party cookies and other tracking technologies are not controlled by us, even if they use our technology to store or collect data. This Privacy Policy asserts that Microsoft Azure Application Insights as configured by WebCareHealth does comply with the rules set forth by the Health Insurance Portability and Accountability Act (“HIPAA”) and the Health Information Technology for Economic and Clinical Health Act (“HITECH”). Your Personally Identifiably Information (“PII”) and Personal Health Information (“PHI”) within App Insights is encrypted in transit and at rest and stored in a physically secure facility. Only authorized agents of WCH have access to the unencrypted data. 

The Company may use what are commonly known as “cookies” or text files, placed on your hard drive by a website’s server. Cookies store information about your first visit to a website, such as your preferred language and pages you visited, and recall that information in order to personalize your next visit. Cookies also help to personalize your web experience. Cookies cannot harm your computer or transfer viruses.

Our web interface requires the use of cookies to operate. If you decline cookies through your browser, our service will not work. We recommend that you interact with our service via our Interactive Telephone System if you wish to not use cookies.

Your Choices and Data Control


WebCareHealth complies with applicable law regarding your ability to access, correct, and delete your Personal Information. If you have an online account, you may be able to log into your account to access and update certain information you provided to us. For Personal Information that is not linked to an online account, for assisting in opting-out of communications, or if you need assistance updating or deleting your Personal Information, please contact us via email at questions@webcarehealth.com, with “ATTN: Privacy” in the subject line. If you send us a letter, please provide your name, address, email address, and detailed information about the change you would like to make.


Privacy Policies of Third Parties

This Privacy Policy only addresses the collection, use, and disclosure of information and data by WebCareHealth and its controlled affiliates. Other websites that may be accessible through this website have their own privacy policies and practices, which govern their use of information that they collect or otherwise obtain from you. We encourage you to familiarize yourself with the privacy statements provided by all such third parties prior to providing them with information or taking advantage of an offer or promotion.


Authorized Individuals

You may grant access to your WebCareHealth account to one or more Authorized Individuals or Authorized Individual-Representatives. You may grant an Authorized Individual access to your account by specifically authorizing WebCareHealth to permit access by such Authorized Individual to your account. When you grant access to an Authorized Individual, you may permit the Authorized Individual to: (a) have the same level of access to your account as you have, i.e., the Authorized Individual will be authorized to access your health record and to communicate with your Providers and/or engage in other transactions with your Providers to the same extent that you are able using WebCareHealth; or (b) have "read-only" access to your account, i.e., the Authorized Individual will be authorized to access and read your health record ONLY, and will NOT be able to communicate with or otherwise engage in transactions with your Providers. Whether or not to grant an Authorized Individual full-access or read-only access to your account is your decision. You acknowledge and agree that: (a) you are solely responsible for verifying the identity of, and monitoring the use by, any Authorized Individual you select; and (b) WebCareHealth has no responsibility or liability in connection with any access to, or use of, your account and information by any Authorized Individual or Authorized Individual-Representative.


Children’s Privacy

This website is not intended for use by children younger than 18 years old. WebCareHealth will not knowingly collect information from site visitors younger than 18 years. However, parents or guardians may elect to utilize the Service on behalf of their children as Authorized Individuals-Representatives and, in doing so, expressly consent to WebCareHealth utilizing such information as set forth in this Privacy Policy and other agreements that may be executed between you and WebCareHealth.


An Authorized Individual-Representative may authorize and/or have access to a records for a minor child or other individual over whom an Authorized Individual has legal authority (“Dependent”). Through the account, the Authorized Individual-Representative may: (a) review and update the Dependent's personal health record as maintained on WebCareHealth; and (b) engage in such communications and transactions as permitted between the Authorized Individual-Representative and the Dependent's Providers through the account. Accounts created for Dependents are specific to each healthcare Provider. Thus, an Authorized Individual-Representative will have to specifically authorize each Provider to establish an account in the name of the Dependent. A Dependent's account will be linked to an Authorized Individual-Representative's account until the earlier of the date: (i) the Dependent reaches the age of 18; (ii) the Authorized Individual-Representative is no longer the legal representative of the Dependent; or, (iii) WebCareHealth is notified by the Dependent's Provider or a court of law or agency with appropriate authority that the Dependent has been emancipated, attained legal custody of his or her own health information, or that a different Authorized Individual-Representative has been named. Each Authorized Individual-Representative agrees that a Dependent's account also may be linked to the account of another Authorized Individual-Representative, and each Authorized Individual-Representative will have the same rights to access and communicate through the Dependent's account.


Information and Data Security

WebCareHealth uses both technical and procedural security measures to maintain the integrity and security of your personal information and other databases, including the use of firewalls. WebCareHealth encrypts all personal health information during transmission between your Provider and WebCareHealth. Within WebCareHealth, all Personal Information is encrypted in transit and at rest. Data at rest is stored in a physically secure facility.


The safety and security of your Personal Information also depends on you. Never share your password with anyone else. Notify WebCareHealth promptly if you believe your password has been breached. Also, remember to log off of the WebCareHealth site before you leave your computer.


Security Breach Notification Requirements

Pursuant to applicable law, WebCareHealth may be required to send you notice of security breaches or suspected security breaches that impact your Personal Information. In the unlikely event that WebCareHealth must provide you a notice of a security breach, WebCareHealth will send you security breach notices to the e-mail address contained in your account information unless we are otherwise require by law. Please note: many e-mail systems have built in SPAM filters. If you have one in place, you should check with your system administrator or the available instructions to confirm that e-mails from WebCareHealth are not blocked by the filter (e.g., by confirming that the Service domain name (webcarehealth.com) is a permitted domain name.


Amendments and Changes

This Privacy Policy may be amended and updated from time to time to reflect new or different privacy practices. We will place notice on our homepage when we make material changes to this Privacy Policy. Additionally, if the changes will materially affect the way we use or disclose previously collected Personal Information, we may also notify you about the change by sending electronic notice to you (if we have your email address).
